Order Dismissing Commercial Fraud Complaint Affirmed by the First Department
An indirect investor in the Bernard Madoff Ponzi scheme brought commercial fraud and conversion claims against a Fund of Fund and its parent companies represented by Tannenbaum Helpern. Tannenbaum Helpern moved to dismiss the Complaint in its entirety. The Supreme Court of New York, New York County, granted the motion in its entirety, and denied the Plaintiff’s subsequent motion for reconsideration, adopting Tannenbaum Helpern’s arguments in full.
The Plaintiff appealed to the Appellate Division, First Department. The First Department affirmed the Supreme Court’s decision, also adopting Tannenbaum Helpern’s arguments.
