Tannenbaum Helpern Successfully Defends a Staffing Firm Against a Conviction Record Discrimination Claim

Tannenbaum Helpern employment attorneys successfully defended a large temporary staffing firm against a charge of discrimination based on a temporary employee’s conviction record and criminal history under the New York State Human Rights Law, including claims that the staffing firm unlawfully performed a criminal background check on the temporary employee. We prepared a strong position statement that set forth our legal arguments and demonstrated the client’s history of lawful employment policies and practices pertaining to background checks as well as our client’s history of affording opportunities to employees with past convictions. After conducting an investigation, based on our arguments, the New York State Division of Human Rights dismissed the temporary employee’s claim.
