Restaurant Industry Wage and Hour Claims
Our employment law attorneys represented a multi-location restaurant group in defending against charges initiated by several former employees with the NYS Department of Labor. The charges included improper tip pooling, failure to pay minimum wage, overtime premiums and spread of hours pay, as well as break time violations. After conducting our own investigation, including a thorough review of available records, interviews with employees and reconstruction of employee schedules, we utilized our extensive experience in the restaurant industry to substantiate our calculations and subsequently to significantly reduce the NYS DOL's determinations and the employer's exposure. We also assisted the restaurants to implement safeguards against the potential for similar suits in the future.
