Federal Court Dismisses Multi-Million Dollar Civil Rico Complaint in its Entirety
An Argentina-based multi-national corporation filed an $8 million civil RICO Complaint against a Tannenbaum Helpern client, asserting claims arising from acts of alleged fraud, extortion and money laundering. Tannenbaum Helpern moved to dismiss the Complaint in its entirety.
The United States District Court for the Southern District of New York granted the motion to dismiss in its entirety, dismissing not only the Plaintiff’s civil RICO claims, but also its related state law claims for breach of contract and unjust enrichment. In adopting many of the arguments and cases presented by Tannenbaum Helpern, the District Court concluded that Plaintiff’s claims – and particularly its civil RICO claims – fell well short of the exacting standards of federal law.
