Dismissal of Attorney Malpractice Case
Representation of a large New York law firm in the successful defense of various attorney malpractice claims brought by a former client who alleged that the law firm had failed to adequately represent the client's interest with respect to a transfer of intellectual property. Tannenbaum Helpern's litigators conducted an intensive review of the law firm's files and were able to locate certain pre-action documentation emanating from the plaintiff which negated the claims. Using the documentary evidence which plaintiff could not legitimately dispute, we were able to obtain the dismissal of the majority of the plaintiff's claims at the trial court level and eventually the entire case in the Appellate Division, First Department. Tannenbaum Helpern attorneys were also able to defeat an attempt by the plaintiff to appeal the dismissal of the case to the Court of Appeals.
