Defending a NY mid-town hotel in a litigation involving Americans With Disabilities Act (ADA)

Our client, a large hotel in mid-town New York City, was sued by a disabled individual claiming, among other things, that the hotel was not fully accessible to disabled people. Tannenbaum Helpern negotiated a resolution to this lawsuit by identifying the most cost effective and efficient means of remediating any existing barriers to access at the client’s hotel. In order to ameliorate the client’s costs in this litigation, Tannenbaum Helpern made an immediate application to stay discovery and arranged for the plaintiff to conduct an inspection of the client’s property with ADA experts present for both our client and the disabled plaintiff. A critical issue in the settlement discussions involved determining how to disburse the mobility and communication features among the different classes of guest rooms available in the hotel.
