Biography
Daniel J. Horwitz is a partner in Tannenbaum Helpern’s Criminal Defense and Litigation and Dispute Resolution practices. A highly experienced trial attorney, Dan is known for his masterful style and a uniquely creative and strategic approach to his cases, as well as his strong legal acumen.
Dan is well known throughout the Federal and State criminal and civil courts in New York, dating back to his tenure with the Manhattan District Attorney’s Office where he served in the Frauds Bureau investigating and prosecuting complex white-collar crimes, including securities, procurement and tax fraud.
Dan’s recent trial experience includes obtaining the full dismissal of a high-profile matter involving False Claims Act claims in which he argued a technically challenging argument under the CPLR. Dan has also secured a full victory in connection with the outright dismissal of trading ahead, fraud and perjury charges by FINRA against the branch manager of a broker-dealer. Also recently, Dan won an acquittal at trial of criminal charges arising from a work-place accident against an executive at a nationally-based construction company at a trial in New York State Supreme Court. And in a truly compelling pro bono matter, Dan represented two men wrongfully convicted of murder in hearings to overturn the convictions. In that case, Dan won a hearing that resulted in the conviction being vacated and charges dropped for one client and won a new trial for the second, at which the client was acquitted of all charges. Both men were ultimately freed from jail following nearly 15 years of imprisonment for crimes they never committed.
Dan frequently appears in connection with the defense of individuals and companies in white-collar criminal and regulatory enforcement investigations, often in parallel with related complex commercial lawsuits and arbitrations. He routinely handles matters before federal and state prosecutors and regulatory agencies, including the U.S. Attorneys for the Southern and Eastern Districts of New York, the Securities and Exchange Commission, FINRA, the Manhattan District Attorney and the New York Attorney General. Dan has also led numerous investigations on behalf of corporations, audit committees, special litigation committees and special board committees. Further, Dan has represented clients in connection with allegations of securities fraud, corporate accounting fraud, insider trading, Foreign Corrupt Practices Act violations, tax fraud, construction industry fraud, money laundering, public corruption, and antitrust violations.
In addition to his law practice, Dan is a Member of the New York State Judicial Screening Committee, and he currently serves on the Transition Team for Manhattan District Attorney Alvin Bragg, where he was a member of the subcommittee on the Office’s Investigation Division. Dan previously served on the Port Authority of New York and New Jersey’s Board of Commissioners, from 2017 to 2023. Dan also previously served on the New York State Joint Commission on Public Ethics, where he was Chair from 2013 until 2016.
Dan began his legal career as a law clerk to the Honorable John T. Nixon in the United States District Court for the Middle District of Tennessee (Nashville). Prior to his legal career, Dan served as Legislative Director and Legislative Assistant to Congressman Thomas J. Downey from 1982 to 1990.
